Terms of Use

The terms that apply when you use ZinCut.

These Terms of Use ("Terms") govern your access to and use of ZinCut ("ZinCut," "we," "us," or "our"), including our website, applications, software, creative tools, subscriptions, and related services.

By creating an account or using ZinCut, you agree to these Terms. If you do not agree, do not use ZinCut.

1. Eligibility

You must be at least 16 years old to use ZinCut.

By using ZinCut, you represent that:

  • You are at least 16 years old;
  • You have the legal capacity to enter into these Terms;
  • The information you provide is accurate;
  • You will comply with applicable laws and regulations.

Businesses and organizations may use ZinCut through authorized users.

2. The ZinCut Service

ZinCut provides creative tools for editing, enhancing, restoring, transforming, generating, and working with images and videos.

Features may include image enhancement, restoration, background editing, generative editing, image generation, fashion-related tools, product tools, video tools, and other creative functionality.

Features, models, providers, availability, and technical capabilities may change over time.

ZinCut does not guarantee that any particular feature will remain available indefinitely.

3. Accounts

Some ZinCut features require an account.

You are responsible for:

  • Providing accurate account information;
  • Keeping your account credentials secure;
  • Maintaining access to your email or authentication provider;
  • All activity performed through your account, subject to applicable law.

You may use valid email, Google, or Apple authentication methods supported by ZinCut.

Account sharing is permitted unless ZinCut states otherwise for a particular feature or plan.

You may maintain more than one account provided that doing so is not used to abuse free credits, bypass restrictions, commit fraud, or otherwise violate these Terms.

4. Your Content

You retain ownership of content that you upload to ZinCut.

You are responsible for ensuring that you have all rights, permissions, licenses, and consents necessary for ZinCut to process the content you upload.

This includes, where applicable:

  • Copyright permissions;
  • Trademark permissions;
  • Rights of publicity;
  • Rights of privacy;
  • Consent from people depicted in the content;
  • Other rights required under applicable law.

By uploading content, you authorize ZinCut to access, process, transmit, store, modify, and otherwise use that content only as reasonably necessary to provide the requested service.

This permission does not transfer ownership of your content to ZinCut.

5. Images Containing People

You may upload images containing other people where you have the legal right and necessary permissions to do so.

You are responsible for obtaining consent where required by applicable law.

You must not use ZinCut to unlawfully exploit, harass, deceive, defame, threaten, or harm another person.

6. AI-Generated and AI-Assisted Content

ZinCut may use artificial intelligence and machine-learning technologies to create or modify content.

AI outputs can be unpredictable.

Outputs may:

  • Contain errors;
  • Be inaccurate;
  • Be inappropriate;
  • Contain visual or factual artifacts;
  • Resemble existing works;
  • Resemble outputs generated for other users;
  • Produce unintended results;
  • Be unsuitable for a particular commercial or legal purpose.

ZinCut does not guarantee that any output is unique, original, exclusive, copyrightable, trademark-safe, privacy-safe, likeness-safe, or legally cleared for a particular use.

You are responsible for reviewing outputs before using, publishing, distributing, selling, or otherwise relying on them.

7. Commercial Use

Subject to these Terms and applicable law, you may use ZinCut outputs for personal or commercial purposes.

Commercial uses may include:

  • Advertising;
  • E-commerce;
  • Social media;
  • Websites;
  • Marketing;
  • Product presentations;
  • Client work;
  • Business materials;
  • Other lawful commercial activities.

However, commercial use does not guarantee that an output is legally cleared for that purpose.

You remain responsible for determining whether your intended use complies with copyright, trademark, publicity, privacy, advertising, consumer-protection, intellectual-property, and other applicable laws.

8. Prohibited Uses

You must not use ZinCut to:

  • Violate applicable laws or regulations;
  • Infringe another person's intellectual-property rights;
  • Violate another person's privacy or publicity rights;
  • Commit fraud or deception;
  • Impersonate another person for harmful or fraudulent purposes;
  • Create fraudulent documents for unlawful purposes;
  • Create or distribute child sexual abuse material;
  • Sexualize or exploit minors;
  • Facilitate abuse, exploitation, trafficking, or violence;
  • Create content intended to facilitate terrorism or serious criminal activity;
  • Harass, threaten, defame, or intentionally harm another person;
  • Circumvent technical restrictions or safety controls;
  • Abuse free credits or promotional systems;
  • Use automated systems to scrape or overload ZinCut without authorization;
  • Reverse engineer or attempt to extract source code, models, or proprietary systems;
  • Interfere with ZinCut's infrastructure;
  • Introduce malware or malicious code;
  • Resell ZinCut access without authorization;
  • Use ZinCut to develop a substantially competing service by systematically extracting or reproducing ZinCut functionality;
  • Attempt to gain unauthorized access to another account;
  • Use multiple accounts to circumvent limits, restrictions, or payment obligations.

Political, public-figure, fictional, violent, mature, or otherwise sensitive content is not automatically prohibited merely because of its subject matter. However, its creation and use must comply with applicable law and these Terms.

ZinCut may restrict particular requests through automated safety systems.

9. Deepfakes and Synthetic Media

ZinCut may allow technologies capable of modifying or generating realistic images and videos.

You must not use ZinCut to create or distribute deceptive synthetic media for fraud, impersonation, harassment, exploitation, or other unlawful or harmful purposes.

Where applicable law requires disclosure, labeling, consent, or other safeguards for synthetic or manipulated content, you are responsible for complying with those requirements.

10. Minors

ZinCut may process ordinary images that contain children when uploaded by an eligible user.

However, you must never use ZinCut to create, process, request, store, distribute, or facilitate sexual content involving minors.

ZinCut may immediately suspend or terminate accounts involved in such activity and may preserve or disclose information where legally required.

11. Your Responsibility for Outputs

You are solely responsible for evaluating and using content produced through ZinCut.

Before publishing or commercially using an output, you should consider whether it:

  • Infringes another person's rights;
  • Uses a person's likeness without permission;
  • Violates privacy rights;
  • Violates trademark rights;
  • Violates copyright;
  • Contains misleading claims;
  • Violates advertising requirements;
  • Violates platform rules;
  • Requires disclosure or labeling;
  • Is otherwise unlawful.

ZinCut is a creative tool and does not provide legal, financial, advertising, copyright, trademark, or other professional advice.

12. Intellectual Property

ZinCut and its underlying technology are owned by ZinCut or its licensors.

This includes, as applicable:

  • Software;
  • Website design;
  • User interface;
  • Branding;
  • Logos;
  • Text;
  • Documentation;
  • Proprietary systems;
  • Software code;
  • Service architecture.

Except as expressly permitted by these Terms, you may not copy, reproduce, distribute, modify, reverse engineer, or exploit ZinCut's proprietary materials.

You retain ownership of your uploaded content.

ZinCut does not claim ownership of your generated outputs.

13. No Claim to Output Exclusivity

AI-generated outputs may not be unique.

Other users may receive similar or substantially similar outputs.

ZinCut does not promise that an output will be exclusive to you or that another person has not created similar content independently.

14. User Content and Marketing

ZinCut does not claim a right to use your uploaded content or generated outputs for ZinCut advertising or marketing.

We will not use your content in ZinCut promotional materials without appropriate permission.

This does not prevent ZinCut from processing content as necessary to provide the requested service.

15. Third-Party AI and Technology Providers

Certain ZinCut functionality depends on third-party technology and AI providers.

Your content may be transmitted to the applicable provider to perform the operation you request.

Third-party providers may change over time.

Third-party services may have their own terms and privacy policies.

ZinCut is not responsible for independent third-party services to the extent permitted by applicable law.

16. Storage and Automatic Deletion

ZinCut stores uploaded and generated content for limited periods.

Current retention periods are:

  • Free: 3 days
  • Starter: 14 days
  • Pro: 30 days
  • Max: 60 days
  • Business: 90 days

Content may be automatically deleted after the applicable retention period.

You are responsible for downloading content you wish to keep.

17. Credits

ZinCut uses credits for certain features and operations.

Credits:

  • Have no cash value;
  • Cannot be transferred between users;
  • Cannot generally be exchanged for cash;
  • May be consumed when an operation is submitted;
  • May be subject to expiration rules described in the Subscription Terms.

Unless otherwise stated, credits consumed by an operation are not restored merely because you dislike the result or choose to regenerate it.

Additional rules governing subscriptions, credits, top-ups, upgrades, downgrades, cancellations, and payments are contained in the Subscription Terms.

18. Free Credits

ZinCut may provide free daily credits or other promotional credits.

The current Free plan provides 150 welcome credits once when you create your account, plus 10 credits per day. Unused Free-plan credits expire at the end of each 30-day free period.

ZinCut may change, suspend, or discontinue promotional credits at any time, subject to applicable law.

Promotional credits may not be sold, transferred, or exchanged for cash.

19. Subscriptions

Paid subscriptions are governed by the Subscription Terms.

Subscriptions may be billed monthly or yearly.

Subscriptions automatically renew unless cancelled before the next renewal.

The Subscription Terms explain how upgrades, downgrades, cancellations, billing intervals, credits, failed payments, and refunds work.

20. Suspension and Termination

ZinCut may suspend or terminate an account where reasonably necessary to:

  • Enforce these Terms;
  • Prevent fraud or abuse;
  • Protect the service;
  • Protect users or others;
  • Address unlawful activity;
  • Address payment fraud or chargebacks;
  • Prevent credit abuse;
  • Respond to legal requirements;
  • Address security concerns.

Where appropriate and legally permitted, ZinCut may provide notice before suspension or termination.

Upon termination, access to your account, Projects, subscriptions, and credits may be lost.

Credits generally have no cash value and will not be refunded solely because an account is suspended or terminated, except where required by applicable law.

21. Copyright and Intellectual-Property Complaints

If you believe content available through ZinCut infringes your copyright or other intellectual-property rights, you may contact:

Please provide sufficient information for us to understand the complaint, including:

  • Your contact information;
  • Identification of the protected work;
  • Identification of the allegedly infringing material;
  • An explanation of the claimed infringement;
  • Any supporting information reasonably necessary to evaluate the complaint.

We may remove, restrict, or preserve content where appropriate.

We may also cooperate with lawful requests from rights holders, courts, regulators, and law-enforcement authorities.

22. Service Availability

ZinCut is provided on an "as available" basis.

We do not guarantee that:

  • The service will always be available;
  • Processing will always be uninterrupted;
  • Outputs will always be generated successfully;
  • Features will remain unchanged;
  • Processing will always be fast;
  • The service will be free from errors;
  • Content will never be lost.

We may perform maintenance, updates, modifications, or temporary service interruptions.

23. Changes to the Service

We may add, modify, limit, suspend, or discontinue features.

We may change AI models, processing providers, technical infrastructure, interfaces, or other parts of the service.

Where applicable law requires notice or other remedies for material changes, we will comply with those requirements.

24. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless ZinCut and its operators, affiliates, service providers, officers, employees, and representatives from claims, losses, liabilities, damages, costs, and expenses arising from:

  • Your violation of these Terms;
  • Your unlawful use of ZinCut;
  • Your uploaded content;
  • Your generated or modified content;
  • Your violation of another person's rights;
  • Your commercial use of outputs;
  • Your fraud, abuse, or intentional misconduct.

This obligation does not apply to the extent a claim results from ZinCut's own unlawful conduct or liability that cannot legally be excluded.

25. Disclaimer of Warranties

To the maximum extent permitted by applicable law, ZinCut is provided "as is" and "as available."

To the extent legally permitted, ZinCut disclaims warranties, whether express, implied, statutory, or otherwise, including warranties of:

  • Accuracy;
  • Reliability;
  • Fitness for a particular purpose;
  • Merchantability;
  • Non-infringement;
  • Availability;
  • Security;
  • Uninterrupted operation.

Nothing in these Terms excludes a warranty or legal protection that cannot lawfully be excluded.

26. Limitation of Liability

To the maximum extent permitted by applicable law, ZinCut will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for losses involving:

  • Lost profits;
  • Lost revenue;
  • Lost business;
  • Lost opportunities;
  • Loss of goodwill;
  • Loss of data;
  • Business interruption;
  • Loss resulting from reliance on AI-generated content.

To the maximum extent permitted by law, ZinCut's aggregate liability arising from or relating to the service will not exceed the greater of:

  1. The amount you paid to ZinCut during the three months immediately preceding the event giving rise to the claim; or
  2. USD $100.

These limitations do not apply where liability cannot legally be limited or excluded under applicable law.

27. Legal Requests

ZinCut may preserve or disclose information when required by law, court order, governmental request, or other valid legal process.

We may also take action necessary to protect users, ZinCut, or others from fraud, abuse, security threats, or unlawful activity.

28. Changes to These Terms

We may update these Terms from time to time.

If material changes are made, we may provide reasonable notice.

Your continued use of ZinCut after the updated Terms become effective means that you accept the updated Terms, except where applicable law requires another form of consent.

29. Governing Law

These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict-of-law principles.

Subject to mandatory rights that cannot legally be waived, disputes relating to these Terms or ZinCut will be subject to the jurisdiction of the competent courts in Jakarta, Indonesia.

Nothing in these Terms limits mandatory consumer protections or other rights that apply to you under the laws of your country of residence.

30. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

31. Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, and Subscription Terms, form the agreement between you and ZinCut regarding your use of the service.

If there is a conflict concerning subscriptions, payments, credits, upgrades, downgrades, or cancellations, the Subscription Terms control those specific matters.
